E-Bike Classes Explained: When Does an E-Bike Become an E-Moto?

Electric bikes have changed. A lot.
Ten years ago, an e-bike usually looked like a bicycle with a battery strapped to it. Today you can buy something with full suspension, fat tires, a long moto-style seat, a giant headlight and enough attitude to look like it should have a license plate.
And that's where things get confusing.
One of the most common questions we hear at Radmoto is:
“Is this actually an e-bike, or is it an e-moto?”
As high-powered electric dirt bikes become more popular, regulators across the United States are starting to answer that question much more clearly.
The general direction we're seeing is this:
Pedals + roughly 750 watts + motor assistance capped at 20–28 mph = e-bike territory.
Start removing the pedals, dramatically increasing power, or allowing the motor to propel the bike well beyond those speeds, and you're increasingly moving into moped, motor-driven cycle, motorcycle or off-road e-moto territory.
There are plenty of exceptions, and every state writes its definitions a little differently.

The Three E-Bike Classes
Most of the United States has settled around some version of the three-class e-bike system. PeopleForBikes says more than 40 states have adopted versions of this framework.

For most three-class states, the bike also needs functional pedals and a motor around the 750-watt regulatory threshold.
That sounds simple.
Naturally, this industry found a way to make it complicated.
Is the Limit Really 750 Watts?
This is one of the most misunderstood parts of e-bike regulations.
Federal consumer-product law defines a low-speed electric bicycle as having fully operable pedals and an electric motor of less than 750 watts, with a motor-only speed below 20 mph under the federal test conditions.
State laws then create the Class 1, Class 2 and Class 3 operating rules.
You'll frequently hear the industry use “750W nominal” or “750W rated” because an electric motor can briefly produce considerably more peak power than its rated output.
For example, a manufacturer may advertise:
750W rated / 1,800W peak
That does not mean the motor continuously produces 1,800 watts.
However, don't assume the words “750W nominal” magically make every bike legal. State statutes don't all use identical language when discussing motor output. The bike still needs to meet that state's speed, pedal, throttle, labeling and operating requirements.
In other words:
Don't judge an e-bike solely by its biggest marketing wattage number.
Look at its manufacturer classification and factory configuration.
What About 28 MPH?
Another common misconception is:
“An e-bike can legally go 28 mph.”
Sometimes.
In the standard three-class system, Class 3 allows motor assistance to 28 mph while pedaling.
A Class 2 throttle generally needs to stop providing power at 20 mph.
So a bike that will propel itself to 35 mph using only the throttle isn't suddenly a Class 3 because it has pedals attached.
That's increasingly exactly the type of loophole regulators are closing.
Looking Like a Motorcycle Doesn't Make It One
This is important because some of our favorite street-legal e-bikes look pretty wild.
A legal e-bike can have:
full suspension, fat tires, moto-style headlights, hydraulic brakes, a long bench seat and BMX or motorcycle-inspired styling.
The government generally cares much more about how the vehicle operates than whether it looks like a Trek commuter bike or something Mad Max would ride to Starbucks.
That's why bikes from companies like ZOOZ, SUPER73, P-51 and Hiboy are interesting.
You can get a bike with serious style without necessarily jumping into motorcycle territory.
For example, ZOOZ currently ships its Ultra Urban and Ultra Flex as 750W Class 2 bikes limited to 20 mph.
P-51's Bullet similarly uses a 750W motor and ships as a 20 mph Class 2 e-bike, despite looking much closer to a little dirt bike than a traditional bicycle.
SUPER73's current models such as the M1D and B1G are also shipping in Class 2, 20 mph configurations.
And Hiboy offers bikes such as the EX11 that ship in Class 2 configuration at 20 mph and can be configured for Class 3 pedal assist up to 28 mph where permitted.
That's increasingly the sweet spot:
Moto looks. Bicycle classification. Much less DMV drama.
So What's Happening to E-Motos?
This is where the national conversation has changed dramatically.
Sur Ron, Talaria, E Ride Pro, Altis and similar bikes typically produce thousands or tens of thousands of watts and can reach speeds comparable to motorcycles.
They're awesome machines.
They're also increasingly difficult to argue are ordinary bicycles.
California's Attorney General issued a consumer alert in April 2026 specifically warning manufacturers, retailers, parents and riders that vehicles exceeding California's e-bike speed and power limits may instead be mopeds or motorcycles. California also warned that modifying an e-bike beyond those limits can change the vehicle's legal classification.
Washington enacted legislation in 2026 specifically addressing the distinction between electric-assisted bicycles and electric motorcycles. The state's law retains the familiar requirement for functional pedals, a maximum 750W motor and the three-class speed structure while lawmakers continue developing a framework for electric motorcycles.
New Jersey went substantially further. Its 2026 law moved Class 2 and Class 3 bikes toward motorized-bicycle treatment and introduced licensing, registration and insurance requirements, making New Jersey one of the country's biggest outliers.
And just this August, national reporting has focused heavily on teenagers riding high-powered e-motos and modified e-bikes, especially in California. The pressure is increasingly falling not just on riders, but on parents, sellers and manufacturers.
So yes:
It is getting harder to ride a 50 mph e-moto down the street and argue that it's just a bicycle because someone installed pedals.
We don't expect that trend to reverse.
What Are the Rules in New England?
Here's where things currently stand across the six New England states as of August 2026.
New Hampshire
New Hampshire has a traditional three-class system.
State law defines an electric bicycle as a pedaled vehicle with an electric motor of less than 750 watts.
Class 1 provides pedal assistance to 20 mph.
Class 2 may use motor power without pedaling but stops assisting at 20 mph.
Class 3 provides pedal assistance to 28 mph.
That puts NH squarely within the mainstream national framework.
Interestingly, New Hampshire lawmakers considered multiple bills in 2026 that would have created additional rules for higher-powered micromobility devices and even registration requirements for Class 3 bikes.
Those proposals were referred for interim study in February 2026 rather than becoming law.
So for now, NH's existing three-class e-bike framework remains intact.
Radmoto read: 🟢 Pretty straightforward. Stay within the class system and you're in familiar bicycle territory.
Massachusetts
Massachusetts is the oddball of the New England group.
Current Massachusetts law recognizes Class 1 and Class 2 e-bikes up to 750 watts and 20 mph.
Massachusetts does not currently recognize Class 3 / 28 mph e-bikes as ordinary e-bikes under its existing statute. MassDOT itself specifically calls this out in its micromobility guidance.
That could change.
Governor Maura Healey proposed a major micromobility overhaul in 2026 that would create a broader speed-based system covering Class 3 e-bikes, mopeds, scooters and faster micromobility devices.
But proposed legislation isn't current law.
So if you're riding a 28 mph Class 3 bike in Massachusetts, don't simply assume the same rules that apply in NH or Vermont automatically apply there.

Maine
Maine uses a very clean three-class framework.
An electric bicycle must have fully operable pedals and an electric motor of less than 750 watts.
Class 1 is pedal assist to 20 mph, Class 2 allows motor-only propulsion to 20 mph and Class 3 allows pedal assistance to 28 mph.
Maine also explicitly addresses modification.
If you modify an e-bike so the motor powers it above 20 mph by throttle or provides pedal assistance above 28 mph, the vehicle is no longer considered an electric bicycle under Maine law.
Maine also limits Class 3 access on many bicycle paths and prohibits riders under 16 from operating Class 2 or Class 3 bikes.
We did not find a major 2026 rewrite replacing this system, so the existing three-class law remains the important framework.

Vermont
Vermont also uses the three-class system.
A Vermont electric bicycle must have fully operable pedals, a seat or saddle and an electric motor of less than 750 watts.
The familiar limits apply:
Class 1: pedal assist to 20 mph.
Class 2: throttle/motor propulsion to 20 mph.
Class 3: pedal assist to 28 mph.
E-bikes generally receive the same rights as bicycles and are exempt from vehicle registration, title, licensing and insurance requirements. Vermont does allow municipalities and agencies to restrict e-bike access to particular paths and trails, and riders under 16 may not operate Class 3 bikes.
Vermont lawmakers were actively discussing e-bike and e-moto classifications in Transportation Committee work during 2026, another indication that the category remains under review.
Radmoto read: 🟢 One of the cleaner three-class states. Trail access still depends on who manages the trail.
Connecticut
Connecticut is especially interesting because it recently tightened the line between e-bike and motor vehicle.
Connecticut uses the standard three classes: 20 mph pedal assist, 20 mph throttle and 28 mph pedal assist.
The state requires working pedals and uses the 750W threshold. Connecticut also specifically excludes bikes that can exceed the Class 2 throttle limit or have been modified so they no longer meet the state's e-bike definition.
Beginning October 1, 2026, Connecticut's definition is being adjusted to expressly include motors rated at exactly 750 watts rather than only motors below 750W.
Vehicles above the e-bike threshold can move into Connecticut's motor-driven cycle or motorcycle categories, which introduce driver-license and potentially registration, endorsement and insurance requirements.
Connecticut also requires helmets for e-bike riders and places additional restrictions on Class 2 and Class 3 trail access.

Rhode Island
Rhode Island officially adopted the three-class system in 2024.
Class 1 provides pedal assistance to 20 mph, Class 2 allows throttle assistance to 20 mph and Class 3 provides pedal assistance to 28 mph.
Rhode Island requires helmets for e-bike operators and passengers under age 21 and gives the Department of Environmental Management authority over e-bike use on state properties.
Rhode Island lawmakers had an interesting debate in 2026.
An early version of H7789 proposed creating a “Class 4” category for bikes exceeding 750W and 28 mph. That proposal was later removed. The substitute bill instead focused on retailer notices and age restrictions. It passed the House but did not complete passage through the Senate during the session.
That's an important signal by itself: lawmakers are actively debating what to call the machines that sit above Class 3.

Can You Make Your E-Bike Faster?
Technically?
Often, yes.
Legally?
That's where the conversation changes.
Many modern e-bikes use programmable controllers and displays, and there is an enormous enthusiast community around modifying them.
If you start Googling, you'll quickly discover that YouTube, Reddit and Facebook owner groups contain plenty of information about changing controller settings, swapping components and modifying electric bikes.
But once you modify the bike beyond the legal limits for its class, it may no longer legally qualify as an e-bike.
That can affect where you can ride it, whether registration or licensing is required, insurance coverage, manufacturer warranty, trail access and liability after an accident.
Some states make that especially explicit. Maine states that once certain motor-assistance limits are exceeded through modification, the vehicle is no longer an electric bicycle. Connecticut similarly addresses bikes modified beyond the legal definition.
So we're not here to be the fun police.
Just understand what you're changing.
You own the modification—and the responsibility that comes with it.
The Bike Can Be Cool AND Legal
This is probably our favorite part of where the market is heading.
Choosing a legal e-bike doesn't mean buying something that looks like it belongs strapped to the back of an RV.
Brands are finally figuring out that riders want style, suspension, big brakes, fat tires, comfortable seats and attitude without necessarily owning another registered motorcycle.
That's why we're excited about bikes from brands including:
ZOOZ, SUPER73, P-51 and Hiboy.
They offer bikes with BMX, moto, café-racer and adventure styling while providing factory configurations designed around existing e-bike classifications.
For riders who primarily want to cruise around Portsmouth, commute to work, hit bike lanes, ride around the beach or explore town without dealing with plates and motorcycle registration, that category makes a ton of sense.
And for riders who want 50+ mph performance?
We love those bikes too.
They're just increasingly being recognized for what they really are:
electric motorcycles and e-motos—not bicycles.
Where We Think the Industry Is Going
The regulatory line is becoming clearer.
For normal bicycle treatment, expect something close to:

28 mph maximum Class 3 pedal assistance where Class 3 is recognized

Proper manufacturer class labeling

Compliance with local age, helmet, road, bike-path and trail rules
Go substantially beyond those limits and expect regulators to start asking whether you're riding a moped, motor-driven cycle, off-road vehicle or motorcycle.
We actually think that's healthy for the long-term industry.
Traditional e-bikes deserve clear access to bicycle infrastructure.
High-powered e-motos deserve a legitimate path toward OHV use and street motorcycle registration.
Trying to pretend they're all the same thing creates problems for both groups.
The technology moved faster than the laws.
Now the laws are catching up.
And we'll keep doing our best to translate the government-speak into something normal humans can understand.
